CareHealth may revise and update the Service Agreement at any time. Your continued use of the Site will mean you accept those changes.
The following terminology applies to the Service Agreement: "customer", "client", "you" and "your" refers to you, the person accessing this Site and accepting the Company’s terms and conditions. "Company", "ourselves", "we" and "us", refers to CareHealth programs, carehealth.me™ or chfor.me™. "Party", "parties", or "us", refers to both the client and ourselves, or either the client or ourselves. Any use of the above terminology or other words in the singular or plural, whether or not capitalized, are taken as interchangeable.
This Site is designed to provide general information about reminders, products and services. Information provided is not intended to constitute an offer to sell or a solicitation of any particular product or service. Some products and/or services may not be available in all states and in many instances may be offered only through this service.

Privacy
We are committed to protecting your privacy. Only our authorized employees on a need to know basis use any information collected from our customers. We constantly review our systems and data to ensure the best possible service to our customers. Congress has created specific offences for unauthorized actions against computer systems and data. We will investigate any incidents and will prosecute or otherwise take action to recover damages against those responsible if we deem it appropriate. This Site has several tools that allow you to access your personal information. You are responsible for taking all reasonable steps to ensure that no unauthorized person shall have access to your CareHealth passwords or accounts. It is your sole responsibility to (1) control the dissemination and use of activation codes and passwords; (2) authorize, monitor and control access to and use of your CareHealth account and password; and (3) promptly inform us of any need to deactivate a password.
Auto Sign-out
After 30 minutes of inactivity on this Site, you will be automatically signed out to help protect your privacy.
Confidentiality
We are required to comply with The Health Insurance Portability and Accountability Act (HIPAA) of 1996 & the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009, and as such, any information concerning clients and their respective records may be passed only to third parties who are our business associates or if we are legally required to do so by the appropriate government authorities. You have the right to request copies of any and all of your records we keep, provided we are given reasonable notice of such a request. You should retain copies of any literature issued in relation to the provision of our services. Where appropriate, we will send you written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
Except as described above, we will not sell, share, or rent your personal information to any third party or use your information for any unsolicited communication(s). Any communication sent by us will only be in connection with the provision of agreed services and products.

If you subscribe to our short message (or text message) service ("SMS"), you thereby agree to receive SMS messages at the address you provide for such purposes. Such messages will come from a CareHealth program, from various short codes (20508 or 66088), or your individual healthcare provider or pharmacy as designated by you.
Participation in our SMS program is free of charge, however carrier message and data rates may apply from your wireless provider. You may terminate the service at any time by following the opt-out instructions below. You represent that you are the owner or authorized user of the wireless device you use to sign up for the SMS program, and that you are authorized to approve the applicable carrier charges.
You can opt-out of our text message program at any time by texting to the short code you received the message from (20508 or 66088),with the keyword "STOP". You may get help information by texting to the short code you received the message from (20508 or 66088), with the keyword "HELP". Message and data rates may apply.

You are fully responsible for taking precautions and providing security measures best suited for your situation and intended use of the SMS program.
CareHealth will never rent or sell your phone number to any third party, nor will we use your phone number to initiate a call or SMS to you without your express or implied prior consent. Your healthcare provider, pharmacy, wireless carrier and other service providers also collect data about your SMS usage, and their practices are governed by their own policies.
Email Terms and Conditions/Privacy
If you subscribe to our email services, you agree to receive email service messages at the address you provide for such purposes. Such messages will come from CareHealth.me or your individual healthcare professional as designated by you.
Participation in our service is free of charge, but you will be responsible for paying any personal internet connection or other internet carrier charges, if any. You may terminate the service at any time by following the opt-out instructions below. You represent that you are the owner or authorized user of the email account/address you use to sign up for the email service. CareHealth will never rent or sell your email address to any third party. Your healthcare provider, pharmacy and email service providers may also collect data about your email usage, and their practices are governed by their own policies.

We do not guarantee that your use of the email service will be private or secure, and we are not liable to you for any lack of privacy or security you may experience. Personal Health Record (PHR) Portal Terms and Conditions/Privacy
If you subscribe to our Portal Health Record ("PHR") services, you agree to receive PHR service messages at the account you provide or create for such purposes. Such messages will come from CareHealth.me or your individual physician, doctor or pharmacy as designated by you.
Participation in our PHR service is free of charge. You may terminate the service at any time by following the opt-out instructions below. You represent that you are the owner or authorized user of the PHR account you use to sign up for the PHR service. CareHealth will never rent or sell your PHR information to any third party. Your physician or doctor, pharmacy and PHR service providers may also collect data about your PHR usage, and their practices are governed by their own policies.
You acknowledge and agree that the PHR service is provided via systems which use the internet to transmit communications over complex networks. We do not guarantee that your use of the PHR service will be private or secure, and we are not liable to you for any lack of privacy or security you may experience. You are fully responsible for taking precautions and providing security measures best suited for your situation and intended use of the PHR service.
You can opt-out of our PHR message program at anytime by canceling your account or calling our toll free number (877-345-1601) and following the simple instructions.
The materials in the PHR are private and may contain Protected Health Information (PHI). If you are the intended recipient, you have authorized this communication with your applicable healthcare provider (physician or doctor or pharmacy).

Exclusions and Limitations
The information on this Site is provided on an "as is" basis. To the fullest extent permitted by law, neither the Company nor any of its affiliates:

Account Cancellation Policy
Both the Client and the Company have the right to terminate the Service Agreement for any reason at any time, and such termination may end services that are already underway. A minimum of 48 hours notice of cancellation is required from the Client. Notification via email, mobile phone text message and/or fax, or any other means will be accepted, subject to confirmation in writing.
Availability
Unless otherwise stated, the services featured on this Site are only available within the United States. Access to this Site may not be legal by certain persons or in certain countries. All message content and any advertising is intended solely for the US market. You are solely responsible for evaluating the fitness for a particular purpose of any programs and information available through this Site. Redistribution or republication of any part of this Site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this Site will be uninterrupted, timely or error free.
Use of the Internet is solely at your own risk and is subject to all applicable local, state, national, and international laws and regulations.
Log Files
We use email and text addresses to analyze trends, administer the Site, track the movement of users, and gather broad demographic information for aggregate use. Addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. Law that Governs Agreement
The Service Agreement is governed by and shall be construed in accordance with the laws of the State of Missouri without giving effect to any principles of conflicts of law. You agree to bring any claims arising under the Service Agreement exclusively in the federal or state courts located in St. Louis, Missouri and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of St. Louis, Missouri. If any provision of the Service Agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Service Agreement and shall not affect the validity or enforceability of any remaining provision.
These terms and conditions form part of the Service Agreement between you and the Company. Except as otherwise expressly provided on this Site, the Service Agreement constitutes the entire agreement between you and CareHealth with respect to the use of this Site and access to its contents. By accessing this Site, you indicate your understanding of, agreement to and acceptance of the Service Agreement contained herein.
